Beta Program Agreement

Please read and agree to these terms if you wish to participate in the Tutti Beta Program. You must be an active Tutti user.

Participation in the Tutti Beta Program

The purpose of the Tutti beta program (the "Beta Program") is to make alpha, beta, seed, and other pre-release products, services and software, and related documentation, materials, and information (collectively, the "Pre-Release Products") available to Beta Program participants from time to time, for the purpose of providing us with feedback on the quality and usability of the Pre-Release Products. You understand and agree that participation in the Beta Program is voluntary and does not create a legal partnership, agency, or employment relationship between you and us. Your participation in the Beta Program does not obligate us to provide you with any Pre-Release Product. We reserve the right to modify the terms, conditions, and policies of the Beta Program from time to time, and to revoke your participation in the Beta Program at any time. If we make changes to the terms and conditions of this Agreement, we will present the revised terms to you on our website.

This Agreement is a binding contract between you and Majestical Roof LLC ("we," "us"). In order to participate in the Beta Program, you must be an active Tutti user subject to our Terms of Service, as well as in compliance with any other agreements related to your use of the Pre-Release Products ("Other Agreements").

By participating in the Beta Program, you certify that you are of the legal age of majority in the jurisdiction in which you reside (at least 18 years of age in many countries) and you represent that you are legally permitted to join the Beta Program.

This Agreement is void where prohibited by law, and the right to become a Beta Program participant is not granted in such jurisdictions.

Other Agreements

If a Pre-Release Product is accompanied by any Other Agreements, you agree to comply with those Other Agreements, and that their terms, as well as our Terms of Service, govern your use of the Pre-Release Product to the extent not inconsistent with this Agreement. Any inconsistency between an Other Agreement (or our Terms of Service) and this Agreement is governed by this Agreement — except that if a Pre-Release Product is accompanied by a separate license in an Other Agreement, that license governs instead of the license grant below.

License Grant and Restrictions

Subject to your compliance with this Agreement, we grant you a personal, limited license to use the Pre-Release Product solely for testing and evaluation purposes, and only in connection with the Beta Program. This license does not grant you the right to use the Pre-Release Product for any other purpose, or to disclose, reproduce, distribute, modify, or create derivative works of the Pre-Release Product. You agree not to decompile, reverse engineer, disassemble, decrypt, or otherwise attempt to derive the source code of any software related to the Pre-Release Product, except to the extent such restrictions are prohibited by applicable law or permitted by the license terms of any open-source components included with the Pre-Release Product. You certify that the Pre-Release Product will only be used for testing and evaluation purposes in connection with the Beta Program, and will not be rented, sold, leased, sublicensed, assigned, distributed, or otherwise transferred. We retain ownership of all Pre-Release Products, and except as expressly set out here, no other rights or licenses are granted or implied under any of our intellectual property.

Fees

There are no fees for participating in the Beta Program under this Agreement. You're responsible for any fees or costs associated with your use of the Pre-Release Product under the terms of our Terms of Service and any Other Agreements.

Term and Termination

Unless otherwise terminated under this Agreement, your rights with respect to a Pre-Release Product end at the earlier of (a) the initial commercial release of a generally available version of that Pre-Release Product, or (b) as provided in our Terms of Service or any Other Agreements.

We may limit your use of a Pre-Release Product at our discretion, including limiting or disabling specific features.

The rights and obligations relating to Limitation on Liability and Feedback below, and any applicable rights and obligations under our Terms of Service or Other Agreements, survive termination or expiration of this Agreement.

Limitation on Liability

Provision of a Pre-Release Product under this Agreement is experimental and creates no obligation for us or any third party to continue to develop, productize, support, repair, offer for sale, or otherwise continue to provide or develop the Pre-Release Product. THE PRE-RELEASE PRODUCT IS PROVIDED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND, INCLUDING THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL WE OR ANY THIRD PARTY BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRE-RELEASE PRODUCT, EVEN IF WE OR SUCH THIRD PARTY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Feedback

You agree to report any flaws, errors, or imperfections you discover in a Pre-Release Product or the Beta Program to contact@majesticalroof.tech. Prompt, accurate reporting is the purpose of the Beta Program, and you agree to use reasonable efforts to report on all aspects of the Pre-Release Product, positive and negative, including answering our questions about your experience. You acknowledge that any improvements, modifications, or changes arising from or in connection with your use of a Pre-Release Product remain or become our exclusive property.

Privacy Policy

By participating in the Beta Program, you agree that we may collect usage, metrics, and other statistics during the program for analysis and to improve the Pre-Release Products. All other data collected in connection with the Beta Program is handled under our Privacy Policy, which is incorporated into this Agreement by reference.

Other Matters

Our failure to act on a breach by you or others doesn't waive our right to act on later or similar breaches. This Agreement doesn't waive rights that can't be waived under applicable consumer-protection laws. Unless we've agreed otherwise in writing, this Agreement is the entire understanding between you and us on this subject, and supersedes any prior discussions, agreements, or understandings, including earlier versions of this Agreement. You may not transfer or assign this Agreement or any rights or licenses granted under it, but we may assign it without notice or restriction, including to an affiliate, parent, subsidiary, or successor. Any other attempted transfer or assignment is void. This Agreement binds and benefits the parties and their successors and permitted assigns. If a court finds any provision of this Agreement invalid or unenforceable, that provision will be interpreted to accomplish its objective as closely as possible, without affecting the enforceability of the rest of the Agreement.
